§1 Scope

These General Terms and Conditions apply to all day trips, sightseeing tours, VIP tours and all other passenger transport services provided by TAGESTOUR-DRESDEN.de as the operator, and to its customers, whether natural persons, legal entities or legal entities under public law.

§2 Booking and Conclusion of Contract

The presentation of our tours is initially for information purposes only and does not constitute a binding offer. By making a booking, you submit a binding offer to enter into a contract. The contract is concluded when we send you our booking confirmation.

If one person makes a booking for several participants, that person also assumes responsibility for the contractual obligations of those participants.

For online bookings, customers must ensure that all information provided is complete and correct. Incorrect information shall be the responsibility of the customer.

The customer must check the booking confirmation immediately and notify the operator of any necessary changes. This also applies to any changes to the customer’s contact details.

§3 Our Services

The scope of services is determined by:

• the respective tour description or individual tour agreement,
• the booking confirmation,
• these General Terms and Conditions.

Services that are not expressly listed are not part of the contract.

Admission fees, meals, personal expenses and other services are only included if expressly stated and contractually agreed.

Routes or scheduled stops may be adjusted by the operator due to traffic disruptions, roadworks, weather conditions or for safety reasons.

§4 Prices and Payment

The prices published at the time of booking apply.

The tour price is due immediately after booking, and the place is only bindingly reserved once payment has been received. If payment is not received within 48 hours of booking, the reservation may automatically expire.

The following payment methods are available:

• Instant bank transfer / bank transfer
• Credit cards: Visa & Mastercard
• Payment by voucher
• PayPal

§5 Vouchers

Vouchers are valid for three years from the date of issue and payment.

Cash payment or bank transfer of the voucher value is not possible. The operator will not provide a replacement in the event of loss of the voucher.

§6 Minimum Number of Participants

Until 31 December 2026, our tours will operate with a minimum of 1 participant. Tours starting from 1 st of January 2027: If the minimum number of 2 participants is not reached, we will inform you no later than 48 hours before the start of the tour. You may choose either to receive a voucher for another tour or to have the purchase price refunded to your original payment method.

§7 Cancellation by the Customer

A booking may be cancelled at any time by email to: info@tagestour-dresden.de

The following cancellation fees apply:

• Up to 14 days before the tour: free cancellation
• 13–7 days before the tour: 25% of the total booking amount
• 6–3 days before the tour: 50% of the total booking amount
• From 2 days to 24 hours before the tour: 90% of the total booking amount
• Less than 24 hours before the tour or in the event of a no-show: 100% of the total booking amount

§8 Substitute Participants

If you are unable to attend, you may nominate a substitute participant free of charge up to 24 hours before the start of the tour.

A short notification by email to info@tagestour-dresden.de, including the relevant ticket number, is sufficient.

§9 Cancellation by the Operator

In rare exceptional circumstances, the operator is entitled to cancel a tour.

This may be necessary, for example, in the event of:

• Illness
• Force majeure
• Severe weather conditions
• Vehicle breakdown
• Road closures
• Official orders or restrictions
• Failure to reach the minimum number of participants

Any amounts already paid will be refunded to the original payment method.

§10 Weather

Our tours generally take place in all weather conditions. Light rain or cooler temperatures do not constitute grounds for cancellation.

If severe weather conditions pose a safety risk, the operator will decide whether the tour can take place.

§11 Vehicle Rules, Arrival at the Meeting Point and Conduct During the Tour

Please arrive at the meeting point 15 minutes before departure.

Please follow the driver’s instructions.

Out of consideration for all participants, loud conversations and controversial political, sporting or religious discussions should be kept to a minimum.

The following are prohibited in particular:

• Smoking or eating inside the vehicle
• Aggressive behaviour
• Harassment of other participants
• Carrying dangerous objects
• Consumption of alcohol or drugs
• Carrying suitcases or travel luggage larger than hand luggage that cannot be stored underneath the participant’s seat or in the participant’s footwell

In the event of serious disruption, we reserve the right to exclude a participant from the tour.

Persons suffering from acutely contagious illnesses or having open wounds are not permitted to participate in order to protect everyone present. Staff are entitled to request a medical certificate confirming that a person with obvious symptoms does not pose a health risk, or to refuse admission.

In all other respects, the operator has the right to enforce the applicable rules and is responsible for the safety and well-being of all guests.

§12 Transport of Dogs, Information for Allergy Sufferers and Passengers Who Are Afraid of Dogs

Dogs are permitted provided they are registered in advance during the booking process.

For space reasons, a maximum of two medium-sized dogs belonging to one owner, with a combined total weight of no more than 35 kg, may be transported on each tour.

The following requirements apply:

• Valid vaccinations
• Dogs must be kept on a leash and must behave in a socially acceptable manner
• The dog owner is liable for any damage caused by the animal
• Dogs are transported in the footwell next to their owner on a separate protective mat

If exceptional cleaning of the vehicle is required, we charge a flat-rate cleaning fee of EUR 50.

When entering the Czech Republic, an EU pet passport must be carried and the dog must be microchipped.

The operator’s right to give instructions and enforce the applicable rules also applies in this regard, with the well-being and safety of everyone participating in the tour taking priority.

If you suffer from a dog allergy or prefer to avoid contact with dogs, please understand that our tours and services may not be the appropriate choice for you.

§13 Mobility Aids

Due to the limited space available in the vehicle, mobility aids can only be accommodated to a limited extent.

Customers must contact the operator in advance to determine whether the respective mobility aid can be carried and transported.

§14 Liability and Insurance Coverage

The applicable statutory provisions shall apply.

We accept no liability for personal belongings unless the loss or damage is caused by intentional or grossly negligent conduct on our part.

During the tour, passenger transport in the vehicle is covered by the operator’s applicable insurance, including in the event of road traffic accidents.

Outside the vehicle, each participant is responsible for themselves, including with regard to material and non-material damage.

This does not apply in cases of gross negligence or intentional misconduct on the part of the operator.

§15 Photographs and Video Recordings

Photographs and video recordings may be made by the operator during the tour.

These may be used for the following purposes:

• Safety and security purposes, including recordings made by the vehicle’s dashcam
• The operator’s website
• The operator’s social media channels
• Advertising and promotional purposes

§16 Data Protection

Your personal data will be treated confidentially and exclusively in accordance with the General Data Protection Regulation (GDPR).

Further information is provided in the Privacy Policy on our website, which forms part of these General Terms and Conditions.

§17 Applicable Law

German law shall apply.

To the extent permitted by law, the place of jurisdiction shall be the Dresden Local Court (Amtsgericht Dresden).

§18 Right of Withdrawal

There is no statutory right of withdrawal for bookings of our day tours.

As these are leisure services provided on a specific date or during a specific period, the statutory right of withdrawal is excluded pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB).

Vouchers: When purchasing a voucher online, the transaction generally does not constitute a leisure service to be provided on a specific date. Consumers therefore generally have a statutory 14-day right of withdrawal for a voucher purchased online pursuant to Sections 355 and 312g BGB, provided that the voucher has not yet been redeemed and no statutory exclusion applies.

The withdrawal must be declared to TAGESTOUR-DRESDEN.de in text form (e.g. by email) within 14 days after conclusion of the contract.

Vouchers that have already been redeemed or vouchers for which the service has been fully performed at the customer’s express request may be excluded from the right of withdrawal, provided that the statutory requirements are met.

§19 Final Provisions

Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
